Article 1 · Seller
MGT CORP OÜ, a company incorporated under Estonian law and registered in the Estonian Commercial Register under number 17612003, with its registered office at Pärnu mnt 66-26, Kesklinna linnaosa, 10135 Tallinn, Harju maakond, Estonia. Email: mgt.management@yahoo.com.
Article 2 · Scope
These terms govern the sale of the STARK and ALPHA chart analysis software and the DUO PACK. Any order implies acceptance of these terms and of the sales contract provided to the customer before payment. In the event of conflict, the signed sales contract prevails.
Article 3 · Products
The main features of each program are described on this website and in the sales contract. The software is a chart analysis tool. It is not an investment service, fund or portfolio management, or personalised investment advice.
Article 4 · Prices
Prices are stated in euros excluding VAT. VAT applicable to the customer’s country and status is added and shown before payment is confirmed. The price payable is the one in force on the day of the order.
Article 5 · Orders and payment
The contract is concluded when the sales contract is signed and the price is paid in full. Payment is made online by card through a secure payment provider. MGT CORP OÜ has no access to the customer’s card details. An order confirmation is sent by email.
Article 6 · Delivery
The software is delivered digitally: download link, licence and installation guide sent by email. Unless immediate installation is requested (Article 7), delivery takes place once the withdrawal period has expired.
Article 7 · Right of withdrawal
In accordance with Directive 2011/83/EU, consumers have 14 days from the conclusion of the contract to withdraw without giving any reason. They inform MGT CORP OÜ of their decision with a clear statement sent to mgt.management@yahoo.com, for example using the form below. The refund is made within 14 days of receipt of the request, using the same payment method as the original purchase.
If the customer expressly requests immediate installation or download of the software before the end of this period, they acknowledge that they lose their right of withdrawal once performance begins. This request and waiver are confirmed in a document signed by the customer before delivery, a copy of which is provided to them.
Article 8 · Licence
The purchase grants the customer a personal, non-exclusive and non-transferable licence to use the software. Copying, reselling, renting, distributing, decompiling or modifying the software is prohibited. MGT CORP OÜ retains all intellectual property rights.
Article 9 · Conformity guarantee
MGT CORP OÜ guarantees that the software conforms to its description, in accordance with Directive (EU) 2019/770 on digital content and digital services. In the event of a lack of conformity, the customer reports it by email. MGT CORP OÜ brings the software into conformity within a reasonable time or, failing that, grants a price reduction or a refund.
Article 10 · Liability
The indicators, signals and alerts provided by the software are analytical information. They do not guarantee any result. The customer remains solely responsible for their decisions on the financial markets and for any resulting losses. MGT CORP OÜ is not liable for interruptions caused by the customer’s equipment, internet connection or third-party platforms. Nothing in these terms limits the rights consumers have under the mandatory rules of their country.
Article 11 · Personal data
Customer data (identity, contact details, order) is used solely to process the order, deliver the software and provide customer support, in accordance with Regulation (EU) 2016/679 (GDPR). It is never sold. Customers may request access to, correction or deletion of their data at mgt.management@yahoo.com.
Article 12 · Governing law and disputes
These terms are governed by Estonian law. Consumers keep the protection of the mandatory rules of their country of residence. In the event of a dispute, the customer first contacts MGT CORP OÜ to seek an amicable solution. They may also refer the matter to the Estonian Consumer Disputes Committee (Tarbijavaidluste komisjon), to the mediation body of their country, or to the competent courts.
